WHY?
For historical reasons, in 1917, the Mexican congress considered a matter of national security limiting the foreigners to be owners of the territory that is 100 kilometers from the border and 50 kilometers (31 miles) from the coast. This ordinance was stated in the Constitution. Starting from 1971 the foreigners can establish " fideicommissums " with Mexican banks or financial institution. Also, the Mexican companies where foreigners have actions no longer need of a " fideicommissum ", only when they are devoted to commercial, industrial, agricultural purposes, etc. Does not apply to residencial purposes.
HOW TO BUY?
On one hand, the bank or financial institution holds the title of the property, legally alone the beneficiary's low instruction acts (owner) of the " fideicommissum ". On the other hand, the owner can have the I title directly with the limitation that when you blindfolds the property, the bank it should sign the transfer of documents. All the rights and obligations of the property belong to the owner.
WHICH IS THE COST?
The bank or financial institution charges an annuity for the establishment and maintenance of the fideicommissum, this goes from percentage fixed rates of 1-1.5% from the total value to the time of the purchase.
HOW LONG?
The fideicommissums are hired for up to 50 years. At the end of this period it could be renewed for a small fee to the notary and it will be able to be sold in any moment.
WILL THIS CHANGE?
It is very probable that in 15 years or less these procedures won't be required and when this happens it will only be required the cancellation paying a fee to the notary.
